Omissions

• The MEP did not specify which parts of the agreement are provisionally applied. Under standard EU practice for mixed agreements, the parts falling under EU exclusive competence (such as trade provisions) are provisionally applied, while those under shared competence require full Member State ratification.
• The Council Decision (EU) 2025/1296 authorising provisional application was adopted on 16 June 2025, well before the signing on 24 October 2025, which provided the legal basis for the 1 March 2026 start date.
